Terms of Use

escolhe.la is an information society service operated from Portugal and reachable at contact-us@escolhe.la, in accordance with Portuguese Decree-Law 7/2004.

By using the site you accept these terms and the Privacy Policy. If you do not agree with them, do not use the service.

It searches for restaurants through the Google Places API, creates a room with a shareable address, and lets anyone holding that address vote on the candidates. There are no accounts, no passwords and no profiles.

escolhe.la does not make reservations, does not handle payments and has no commercial relationship with the restaurants it shows. The booking button sends you to the restaurant's own site or to Google Maps; what happens there is between you and that business.

There are no invitations and no permissions: anyone who knows a room's address or code can see the candidates, vote, and see the results. Treat the address the way you would treat a link to a shared document.

For that reason, do not type into the search — or any other field — information you would not want the whole group to see. Search fields are not the place for personal data, yours or anyone else's.

In using escolhe.la you agree not to:

• Use the service for unlawful purposes, to harass others, or to distribute illegal content.
• Automate requests, scrape data, or generate traffic that degrades the service for others.
• Attempt to reach other people's rooms, in particular by guessing or enumerating room codes.
• Circumvent technical limits, security measures or the voting mechanism, including voting on behalf of participants who do not exist.
• Reproduce or resell data obtained through the service, in particular the third-party data identified in clause 5.

We may delete rooms and block access that breaches this clause, without prior notice and without any obligation arising for us.

The restaurants, addresses, ratings and photos shown come from the Google Places API. By using escolhe.la you are also using Google Maps and you accept the Google Terms of Service and the Google Maps/Google Earth Additional Terms of Service, which are incorporated into these terms. The Google Privacy Policy also applies.

We neither verify nor warrant the accuracy of that information: opening hours, addresses, prices and ratings come from Google and may be out of date or wrong. Always confirm with the restaurant before travelling.

The map on the results page uses data © OpenStreetMap contributors, made available under the Open Database License.

The escolhe.la name, the design of the site and its source code belong to the service operator. Third-party content belongs to its rights holders and is used under the terms identified in clause 5.

The service is free and provided with no commitment as to availability, performance or continuity. We may change, suspend or discontinue it, in whole or in part, at any time.

Rooms are deleted 90 days after they are created. escolhe.la is not a storage service: a deleted room cannot be recovered. If you want to keep the outcome of a vote, keep it yourself.

The service is provided "as is" and "as available", with no warranty that it is error-free or fit for any particular purpose.

To the extent permitted by law, we are not liable for decisions taken on the basis of a vote's results, for inaccurate information originating from third parties, for unavailability of the service, or for the loss of rooms, votes or the identifier stored on your device.

Nothing in these terms excludes or limits liability that Portuguese law does not permit to be excluded or limited — in particular for wilful misconduct, gross negligence, or death and personal injury — nor does it affect any rights consumer protection law gives you.

We may change these terms. The version in force is always on this page, with the date of the last update at the top. Using the service after that date means accepting the version in force; if you do not accept it, simply stop using the service.

These terms are governed by Portuguese law.

If you are a consumer resident in the European Union, you may bring proceedings in the courts of your own domicile and, in Portugal, turn to the alternative consumer dispute resolution bodies provided for in Law 144/2015, in particular the Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (CNIACC), www.cniacc.pt. We are not bound to any particular alternative dispute resolution body.

Otherwise, the courts of the district of Lisbon have exclusive jurisdiction.
